Ontario Human Rights Law
Human Rights Law in Canada and Ontario provide that all employees have the right to equal treatment with respect to employment without discrimination. Provincial human rights statutes state that every person has a right to equal treatment with respect to employment without discrimination based on:
- Age;
- Ethnic origin;
- Place of origin;
- Colour;
- Ancestry;
- Citizenship;
- Creed;
- Sex;
- Race;
- Prior record of offences;
- Marital status;
- Family status;
- Sexual orientation; and/or
- Disability (mental or physical)
The Ontario Human Rights Code is the law that protects most employees in Ontario against discrimination in the workplace. Similarly, the Canadian Human Rights Act prohibits discrimination at federally regulated businesses, such as banks, airlines and telecommunication companies.
Workplace Human Rights violations typically include issues involving unfair hiring practices, terminations, sexual harassment or not accommodating an employee’s workplace disability.

Discrimination takes place in different ways. Usually, it involves some differential treatment based on a person’s human characteristics that impacts a person negatively compared to other people (e.g., not providing a promotion to a person because of their older age).
If an employee proves a violation of their human rights, they may be awarded damages, including compensatory damages, back pay, re-instatement and punitive damages.
